
There was a major discussion during the 150th General Assembly to start using vote by mail in Delaware elections.
HB 75 was created to change the Delaware Constitution, which takes a 2/3 vote over two consecutive sessions, to allow for anyone to vote absentee.
What was uncovered was that HB 75 would grant the General Assembly unrestricted authority to place rules and procedures on absentee voting and ultimately the creation of vote by mail.
This is why I voted against the bill. That effort was defeated in the second leg of the Constitutional Amendment when a 2/3 vote count was not reached.
Since that move to control the rules of the election could not be turned over to the majority party through HB 75, lawmakers of the majority party have now created SB 320 that outright ignores the legal procedure to change the Delaware Constitution.
This bill uses simple majority rule to set up vote by mail, without proper identification.
The one party, super majority legislature has abused its power too many times.
We must elect representatives that are not looking for a way to beat the system to fit their agenda, rather ones that are willing to work together to take on the challenges in our neighborhoods.
We cannot have our elections controlled by majority rule, allowing whichever party that is in power to create rules and procedures that benefit their party and incumbents in the next election cycle, let alone the current one.
This proposed law would go into effect July, 1 2022 and be imposed on this year's Primary and General elections.
Please call and email the below Senators and Representatives that are sponsoring SB 320 and let them know we do not want them to override the Delaware Constitutional process through majority overreach.
